What is a Geographical Indication?

A geographical indication is the indication of quality that guarantees and indicates the source of the product, the characteristics and the link between relevant characteristics of the product and the geographical area for consumers. Geographical Indication registration helps protect the products that have been renowned depending on their quality, traditionality, raw material gathered in the local area and local properties.

In accordance with Intellectual Property Law no. 6769’s 34th article;

Geographical Indication
It is the indication that indicates the product which has been identified with a country, region, field or locality that it has its roots in with regards to a certain characteristic, reputiation or other qualities. Geographical indications are registered as the name of origin or origin indication. Food, agriculture, mining industries, crafts, industrial products can be subjected to geographical indication registration.

Name of origin
If a product’s whole quality or essence stems from natural and artificial factors of a certain geographical area, aforesaid geographical indications are named “Name of origin”. Production, process and other operations are required to be operated in the determined geographical area.. In this context, the geographical indications that are registered as names of origin are strongly bonded with where they stem from.

Indication of origin
The geographical indicatons which subject the products that have been identified with a certain geographical area owing to a certain quality, reputation or other properties of theirs and predetermined to be processed within a certain geographical area are named “Indications of origin”. As long as one of the product’s process steps, which are raw material, production and process, is performed within the geographical area and it is registered with an indication of origin, other steps of process can take place outside the region.

Why must the logo be used?

The purpose of the logo is to inform the consumers about the product’s having a geographical mark/ traditional name and help with the examination.

Ürünün tedarik zinciri içerisinde özellikle tüketici ile temas ettiği noktalarda, ürünün niteliğine ve satış yerine göre farklı şekillerde ürüne eşlik edecek olan amblem ile ürünün coğrafi işaret olduğuna ilişkin “farkındalık” oluşacaktır. Tedarik zincirinin, ürünün tüketici ile doğrudan temas etmediği aşamalarındaki amblem kullanımı ise denetim faaliyetlerini destekleyecek, ürünü üreten, hasat eden, satışa hazır hale getiren, toptan veya perakende satan, servis eden tüm aktörlerin, bu ürünün coğrafi işarete veya geleneksel ürün adına sahip olduğunu fark etmelerini ve depolama, taşıma, satış vb. faaliyetler esnasında ayırt edici özelliklerinin bozulmaması için tescil belgesinde belirtilen hususlara uymaları konusunda farkındalık oluşmasını ve azami gayret göstermelerini sağlayacaklardır.

Is logo usage obligatory?

The geographical indication being the names of our products “Antep Baklava”, “Edremit Olive Oil”, “Malatya Apricot”, “Aydın Fig”, “Edremit Scratched Green Olives”; when used with them, the logo usage is obligatory.

Using of the registered traditional product name without its logo is not subjected to the provisions of the Law no. 6769. Hence, when a registered product name is not used on a product with its traditional product name logo, it is not required to comply with the relevant registration scope.

What is the case for products that have been launched before the legislation?

There is not an exception in the legislation for the products that had been launched before the Logo Legislation came into force and where it is not possible for the logo to be printed on the packing. Logo usage is obligatory with said products as from 10th of January, 2018.

Usage of the aforesaid logos will be examined by the department or office concerned that is stated in the registration license and for the agriculture and food products, Ministry of Food, Agriculture and Livestock.

From where can the logo be procured?

It is stated in the regulation that the logo can not be sold.

Can the logo be altered?

  • Color, shape and the inscriptions of the logo can not be altered.
  • Logo diameter can not be under 15 milimeters.

Which emblem should I use?

  • Menşe adı, mahreç işareti ve geleneksel ürün adı olarak tescil edilmiş coğrafi işaretler için farklı amblemler bulunmaktadır. Coğrafi işaret türüne göre uygun olan amblem kullanılmalıdır. Menşe adı olarak tescillenmiş “Ezine Peyniri” ambalajı üzerinde kırmızı renkli ve “Menşe Adı” ibaresi içeren amblem, mahreç işareti olarak tescillenmiş “Beypazarı Kurusu” ambalajı üzerinde ise yeşil renkli ve “Mahreç İşareti” ibaresi içeren amblem kullanılmalıdır.
  • Yurt dışına ihraç edilecek ürünler üzerinde İngilizce kullanılması tercih edilirse Türk Patent internet sayfasında yer alan İngilizce amblem kullanılacaktır.
  • Ambalajda yer alan diğer tüm unsurların sadece siyah, sadece beyaz veya siyah-beyaz olması halinde amblemin siyah-beyaz kullanımı da mümkündür.

How is the logo used on the product?

The logo is used directly on the product or on its package.

As for the Finike Orange geographical indication, it can be used visibly on the crates in which the oranges are transported. As for the Devrek Baton geographical indication, it is possible for the logo to be used directly on the baton, as it is not a food product.

However, if sticking it to the products respectively is to cost too much, downgrade the product or not possible due to the product size; it is possible for the logo to be applied on packages.

In the cases where the logo is not used on the product or its package, it is to be used in the business with a form that can be easily discerned.

As for the Konya Meated Bread geographical indication, the logo can be used on a sign, menu, wall etc.

As for the Buldan Linen geographical indication, if the sticking of the logo is to downgrade the product, it can be used on the stall, counter etc. with its geographical indication explained.
